Discrimination

Discrimination is illegal when it is based on a “Protected Class” or “Protected Classification.”  Protected classes, include but are not limited to: Age, Disability, Race, Origin, Color, Religion, Pregnancy, Sex and other characteristics. 

Family Medical Leave Act

The FMLA entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons with continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave.


Sexual Harassment

Legally, workplace sexual harassment is considered a form of sex discrimination, so sexual harassment is illegal across the country. Generally, these federal laws apply only to employers with 15 or more employees.

Veteran Employment Issues

Under USERRA, employers must make “reasonable efforts” to help a veteran who is returning to employment to become qualified to perform the duties of the position he or she would have held but for military service whether or not the veteran has a service-connected disability.

 

Workerman Comp Retaliation

Retaliation occurs when an employer penalizes an employee, or employees, for engaging in a protected activity.  In workers’ compensation, that means an employer punishes an employee for filing a workers’ comp claim, or in some cases even attempting to file a claim.

Wage/Hours/Benefits

Individuals who believe they have been paid at a rate lower than the law requires may choose to take legal action.

An individual has two years from the date wages were due to file a lawsuit to recover the unpaid wages plus an additional equal amount in damages.
